About us
These Terms and Conditions are issued by Bad Apple Limited, trading as Bad Apple Live ("Promoter", "we", "our", "us"), a company registered in Ireland.

By purchasing a ticket, you agree to be bound by these Terms and Conditions and any venue-specific conditions applicable to the event.
SECTION 2
Ticket purchase
2.1 Tickets are issued subject to these Terms and Conditions and any venue-specific conditions.
2.2 A valid ticket must be produced for entry to the event.
2.3 Tickets may not be resold for commercial gain or above face value without the prior written consent of the Promoter.
2.4 The Promoter reserves the right to cancel any ticket purchased in breach of these Terms without refund.
2.5 By completing a ticket purchase, you confirm that you are aged 18 or over, or that you have the consent of a parent or guardian where required.
2.6 Ticket purchases are made through Universe. The Promoter is not responsible for technical issues arising on third-party ticketing platforms.
SECTION 3
Your statutory rights
Nothing in these Terms affects statutory rights you are entitled to by law.
3.1 Nothing in these Terms and Conditions excludes or limits any statutory rights that you are entitled to as a consumer under applicable law, including rights under Irish consumer law, the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013, or where applicable, the UK Consumer Rights Act 2015.
3.2 If you are resident in the United Kingdom, your statutory rights under UK law are not affected by these Terms. To the extent that any provision of these Terms is inconsistent with your UK statutory rights, your statutory rights shall prevail.
3.3 These Terms should be read in conjunction with any applicable consumer protection legislation in your country of residence.
SECTION 4
Distance selling and cancellation rights
4.1 Tickets purchased online or by telephone are subject to distance selling regulations. However, in accordance with Regulation 28(1)(h) of the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013 and the equivalent provisions under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the 14-day statutory right to cancel does not apply to contracts for the provision of services related to leisure activities where the contract provides for a specific date or period of performance.
4.2 Event tickets are therefore exempt from the standard 14-day cancellation right because they relate to a specific event date. This exemption is a standard and lawful feature of event ticketing across Ireland and the United Kingdom.
4.3 You will be informed of this exemption at the point of purchase.
SECTION 5
No refund policy
5.1 Except where required by applicable law or as expressly stated in these Terms, all ticket purchases are final and non-refundable.
5.2 Refunds will not be provided due to:
Changes in personal circumstances
Travel disruption
Illness or injury
Adverse weather (where the event proceeds)
Changes to the event programme
Changes to supporting artists
Changes to performance times
Changes to venue facilities
Delays or interruptions during the event
5.3 Customers are strongly advised to obtain appropriate ticket and travel insurance to cover personal circumstances that may prevent attendance.
SECTION 6
Event changes
6.1 The Promoter reserves the right to alter the advertised programme at any time.
6.2 Artists, performers, support acts, speakers, hosts, DJs or other advertised attractions may be added, removed or substituted without notice.
6.3 Such changes shall not entitle the ticket holder to a refund unless required by applicable law.
6.4 Performance times are subject to change without notice.
SECTION 7
Venue changes
7.1 The Promoter reserves the right to change the venue where reasonably necessary.
7.2 A venue change within the same city, county or metropolitan area shall not constitute grounds for a refund.
7.3 Where a venue change results in a materially different event experience, the Promoter will notify ticket holders as soon as reasonably practicable.
7.4 Seating, viewing arrangements and event layouts may be amended for operational, safety or production reasons.
SECTION 8
Postponement
8.1 If an event is postponed, tickets shall remain valid for the rescheduled date.
8.2 Where a rescheduled date is announced, ticket holders who are unable to attend the new date may contact us at live@badapple.ie within the timeframe communicated at the time of the postponement announcement. Refunds following postponement are provided at the sole discretion of the Promoter except where required by law.
8.3 The Promoter shall not be responsible for any travel, accommodation, subsistence or other consequential costs incurred by ticket holders as a result of any postponement.
SECTION 9
Cancellation
9.1 If an event is cancelled and not rescheduled, ticket holders may be entitled to a refund of the ticket face value only.
9.2 Booking fees, transaction fees, delivery fees and other ancillary charges may be non-refundable unless required by law.
9.3 The Promoter shall not be responsible for any travel, accommodation, subsistence or other consequential costs incurred by ticket holders as a result of any cancellation.
SECTION 10
Force majeure
10.1 The Promoter shall not be liable for cancellation, postponement, interruption or modification of an event caused by circumstances beyond its reasonable control.
10.2 Such circumstances include but are not limited to:
Severe weather or flooding
Fire or natural disasters
Public health emergencies
Government restrictions or directives
National security concerns
Industrial disputes
Acts of terrorism
Utility failures
Venue unavailability
Police, local authority or emergency service requirements
Garda Síochána operational requirements
10.3 Where an event is affected by force majeure, the Promoter will endeavour to communicate with ticket holders as promptly as possible through official channels.
SECTION 11
Age restrictions
11.1 Some events are designated as over-18s only. Where an age restriction applies, it will be clearly stated on the event listing and at the point of purchase.
11.2 For over-18 events, valid photographic ID will be required for entry. Accepted forms of ID include a passport, driving licence or other government-issued photo identification.
11.3 Ticket holders who are refused entry due to failure to produce satisfactory ID or failure to meet the age requirement will not be entitled to a refund.
11.4 Where an event permits attendance by persons under 18, they must be accompanied by a responsible adult aged 18 or over at all times. The accompanying adult accepts responsibility for the minor's conduct at the event.
11.5 The Promoter reserves the right to refuse entry to any person who cannot demonstrate compliance with the applicable age restrictions for an event.
SECTION 12
Ticket authenticity and authorised channels
12.1 Tickets are only valid when purchased through authorised channels. For Bad Apple Live events, the authorised ticketing platform is Universe. Links to authorised sales pages are available at www.underthegiant.com and our official social media channels.
12.2 The Promoter accepts no responsibility for tickets purchased through unauthorised third-party platforms, secondary resale sites, or private individuals. Such tickets may be invalid, counterfeit or duplicated and may be refused entry without refund.
12.3 If you believe you have purchased a fraudulent or invalid ticket, please contact us at live@badapple.ie as soon as possible.
12.4 The Promoter reserves the right to invalidate any ticket it reasonably suspects has been fraudulently obtained, duplicated or misrepresented.
SECTION 13
Ticket transferability
13.1 Tickets may be transferred to another person as a gift or for personal reasons at face value only, provided the transfer is not for commercial gain.
13.2 The Promoter does not facilitate name changes on tickets. The original purchaser is responsible for ensuring that the ticket reaches the intended attendee.
13.3 In the event of a dispute over ticket ownership, the Promoter may treat the ticket as belonging to the original purchaser of record.
13.4 Tickets must not be advertised or sold above face value. The Promoter reserves the right to cancel any ticket it reasonably believes has been resold above face value, without refund.
SECTION 14
Admission
14.1 Admission is subject to compliance with venue and event rules, which will be communicated in advance of the event where reasonably practicable.
14.2 The Promoter reserves the right to refuse admission or remove any person whose behaviour is deemed unsafe, disruptive, offensive, or unlawful, or who appears to be under the influence of alcohol or other substances to a degree that presents a risk to themselves or others.
14.3 No refund shall be provided where admission is refused or revoked under this clause.
SECTION 15
Search and security
15.1 Ticket holders may be subject to security screening and searches as a condition of entry.
15.2 Prohibited items may be confiscated. A list of prohibited items will be published on the event website in advance of the event.
15.3 Refusal to comply with security procedures may result in refusal of entry without refund.
SECTION 16
Accessible ticketing
16.1 Bad Apple Limited is committed to making its events accessible to all attendees. In compliance with the Equal Status Acts 2000 to 2018 (Ireland) and, where applicable, the Equality Act 2010 (United Kingdom), we will take reasonable steps to accommodate the needs of ticket holders with disabilities.
16.2 If you require accessible seating, viewing areas, or any other reasonable adjustment, please contact us at live@badapple.ie in advance of the event so we can make appropriate arrangements.
16.3 Personal assistants or carers accompanying a disabled ticket holder may be entitled to attend at no additional charge, subject to availability. Please contact us to discuss your requirements.
16.4 We endeavour to communicate accessibility information clearly on our event listings. If you have any questions about accessibility at a specific event, please contact us before purchasing a ticket.
SECTION 17
Recording and photography
17.1 Ticket holders may be photographed, filmed or recorded during the event.
17.2 By attending, ticket holders grant the Promoter the right to use such images and recordings for promotional, commercial and archival purposes without compensation.
17.3 Unauthorised professional recording or photography equipment may not be brought into the venue without the prior written consent of the Promoter.
SECTION 18
Payment and pricing
18.1 All ticket prices are displayed in the currency of the event's primary market at the time of purchase. Prices are inclusive of any applicable taxes unless otherwise stated.
18.2 Where tickets are purchased in a currency other than your local currency, any currency conversion costs are the responsibility of the purchaser. The Promoter is not responsible for exchange rate fluctuations or conversion fees applied by your payment provider.
18.3 In the event of a failed payment, your ticket will not be issued and your place at the event is not guaranteed.
18.4 Chargebacks or payment disputes raised without first contacting the Promoter may result in the cancellation of the associated tickets without refund. If you have a concern about a charge, please contact us at live@badapple.ie in the first instance.
18.5 The Promoter reserves the right to correct any pricing errors. Where a ticket has been purchased at an incorrectly displayed price, the Promoter will offer the customer the choice of purchasing at the correct price or receiving a full refund.
SECTION 19
Liability
19.1 Attendance at events is at the ticket holder's own risk.
19.2 The Promoter shall not be liable for any loss, theft or damage to personal property at or in connection with an event.
19.3 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under Irish or UK law.
SECTION 20
Data protection and communications
20.1 Personal information collected at the point of ticket purchase will be processed in accordance with the Bad Apple Limited Privacy Policy, which is available on request and on our website.
20.2 We process personal data in compliance with the General Data Protection Regulation (GDPR) as retained in Irish law and, where applicable, the UK GDPR.
20.3 By purchasing a ticket, you agree to receive transactional communications from us relating to your booking, including booking confirmations, event information, schedule changes, and other updates directly related to your ticket purchase.
20.4 We will not use your personal data for marketing purposes without your separate consent. You may withdraw your consent to marketing communications at any time by contacting us at live@badapple.ie.
20.5 Your personal data may be shared with third-party service providers (including our ticketing platform) solely for the purposes of processing your ticket purchase and administering your attendance. We do not sell personal data to third parties.
SECTION 21
Governing law and jurisdiction
21.1 These Terms and Conditions are governed by and construed in accordance with the laws of Ireland.
21.2 For ticket holders resident in the Republic of Ireland, any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Irish courts.
21.3 For ticket holders resident in the United Kingdom, nothing in these Terms affects your right to bring a claim before a UK court. UK consumer rights legislation (including the Consumer Rights Act 2015) applies to UK resident consumers and is not displaced by the Irish governing law clause.
21.4 For ticket holders resident outside Ireland and the United Kingdom, these Terms shall be governed by Irish law, though we acknowledge that local mandatory consumer protection laws in your country of residence may also apply.
21.5 If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
